Terms & Conditions
Photography Terms and Conditions for Your Session
These Photography Terms and Conditions apply to services provided by Sylvia Dobek Photography LTD in Enfield, North London.
Please read these Terms & Conditions carefully before booking. If you have any questions, you are welcome to contact Sylvia Dobek Photography before confirming your session.
1. Booking Your Photography Session
A photography session is considered booked once the date, time and session type have been agreed with Sylvia Dobek Photography.
Availability is subject to the studio diary and cannot be guaranteed until your booking has been confirmed.
Newborn sessions are arranged with flexibility around the baby’s arrival. An estimated due date may be used when planning availability, with the final session date confirmed once the baby has been born.
You can find further information about how newborn sessions work on the Newborn Photography London page.
For maternity, family, cake smash and other photography sessions, the agreed appointment date and time should be treated as your reserved studio slot.
2. Session Fees and Payment
The price of your session will be the price confirmed at the time of booking.
Unless a different payment arrangement has been agreed in writing, the full session balance is due on the day of the photography session and can be paid by bank transfer or cash.
For Bump to Baby Collections, payment may be divided between the two sessions, with 60% payable in connection with the maternity session and the remaining 40% in connection with the newborn session.
Details of current photography collections and pricing can be found on the relevant session pages, including Maternity Photography, Family Photography and Cake Smash Photography.
Prices may change from time to time, but any price already confirmed for an existing booking will remain subject to the terms agreed at the time of booking.
3. Rescheduling and Cancellations
If you need to reschedule your photography session, please contact Sylvia Dobek Photography as soon as possible.
Rescheduled appointments are subject to studio availability.
For newborn sessions, reasonable flexibility is always allowed where recovery after birth, Caesarean section, premature birth, feeding difficulties or medical circumstances mean that the original timing is no longer suitable.
If Sylvia Dobek Photography needs to reschedule a session because of illness, emergency, equipment failure or circumstances outside reasonable control, an alternative appointment will be offered as soon as possible.
Nothing in these Terms & Conditions affects any statutory rights that you may have as a consumer.
For independent information about consumer rights in the UK, you can refer to Citizens Advice consumer guidance.
4. Late Arrival
Clients are responsible for arriving at the agreed time.
If you arrive late, Sylvia Dobek Photography will make reasonable efforts to complete the session, but the appointment may need to finish at the originally scheduled time if another client is booked afterwards.
A late arrival does not automatically entitle the client to additional studio time, additional images or a reduction in the session fee.
5. Newborn Photography and Baby-Led Sessions
Newborn photography sessions are always approached with the baby’s comfort and safety as the priority.
No specific pose, photograph, expression or sleeping position can be guaranteed.
Babies are individuals. Some sleep throughout much of their session, while others remain awake, require additional feeds or cuddles, or do not tolerate certain positions.
Sylvia Dobek Photography will never force a newborn into a pose simply to recreate a particular image.
Older newborn babies can still be photographed, although the poses and style of the session may need to be adapted to their age, flexibility and level of alertness.
More information is available in the newborn photography session guide.
6. Children and Family Sessions
Parents and guardians remain responsible for supervising their children throughout the photography session except when a baby is being positioned or photographed directly by the photographer.
Children cannot be guaranteed to smile, look at the camera or cooperate with every planned photograph.
The photographer will use experience, patience and age-appropriate interaction to create the best possible gallery, but individual expressions and poses cannot be guaranteed.
Sessions involving children over six months are generally treated as family photography sessions unless a different session type has been specifically agreed.
You can read more about these sessions on the Family Photography London page.
7. Pets During Photography Sessions
Pets may be included in suitable family photography sessions where this has been discussed in advance.
The owner remains responsible for the behaviour, supervision and control of their animal while at the studio.
Parents and pet owners are responsible for deciding whether interaction between a child and pet is safe and appropriate.
Sylvia Dobek Photography may decline or stop a particular setup if there is any concern about the safety of a child, baby, animal or other person present.
8. Styling, Props and Outfits
A selection of newborn wraps, outfits, props and accessories is available in the studio.
Availability of a particular prop, outfit, backdrop or setup cannot always be guaranteed.
Clients are welcome to discuss colour preferences and styling ideas before the session.
Reference photographs may be used as inspiration, but Sylvia Dobek Photography does not guarantee an exact recreation of another photograph, photographer’s work, pose, prop arrangement or lighting setup.
9. Image Selection
After the photography session, clients may be invited to select their preferred photographs from an online gallery or proofing selection.
Where applicable, image numbers can be supplied by screenshot or by providing the final digits of the photograph reference.
Selections should be made within the timeframe communicated with the gallery.
If the client does not make a selection within the requested period, Sylvia Dobek Photography may proceed using a photographer-selected edit where this has been explained in advance.
10. Editing and Retouching
The final images are professionally edited in the established style of Sylvia Dobek Photography.
Editing may include colour correction, exposure adjustment, skin retouching, background refinement and other artistic finishing considered appropriate by the photographer.
The photographer retains creative discretion over the final editing style.
Requests for substantial alterations beyond the normal editing process may be subject to an additional fee.
Clients should choose Sylvia Dobek Photography because they are comfortable with the style shown in the photographer’s portfolio.
11. RAW and Unedited Files
RAW camera files are not supplied to clients.
Unless specifically included in a particular offer, unedited photographs are not part of the standard photography package.
Where an unedited gallery or unedited-file add-on is offered, those files are provided under the specific conditions communicated for that session.
Unedited photographs should not be treated as representative of the photographer’s finished professional work.
12. Digital Images
The number of professionally edited digital images supplied depends on the photography package purchased.
Additional edited photographs may be available for purchase where permitted by the selected collection.
Some special sessions may have restrictions on purchasing additional edited photographs. These restrictions will be stated clearly in the relevant session description.
Digital images are supplied for the client’s personal use.
Clients are strongly encouraged to download their finished gallery promptly and keep multiple backup copies.
13. Albums, Prints and Photography Products
Albums, prints, triplets, USB products and other physical items are produced according to the specifications approved by the client.
Clients are responsible for carefully checking image selections, album layouts, names, dates, wording and other personalised information before final approval.
Once a personalised product has entered production, changes may no longer be possible.
Additional album pages, upgrades or optional extras may incur additional charges where applicable.
Colours displayed on screens can vary slightly from printed materials, photographic paper, album covers and other physical products.
14. Delivery Times
Editing and product delivery times may vary depending on the type of session, time of year, workload and products ordered.
Any estimated delivery time provided is an estimate rather than a guaranteed deadline unless specifically agreed otherwise in writing.
During particularly busy periods, including Christmas mini-session season, turnaround times may differ from standard sessions.
15. Gallery and File Storage
Clients are responsible for downloading and safely backing up their completed photographs.
Edited images are normally retained by Sylvia Dobek Photography for up to six months, although permanent storage is not guaranteed.
Unedited files may be retained for approximately four weeks after the relevant session or selection period.
Where a private gallery is requested, different deletion arrangements may apply and will be communicated directly to the client.
Once the communicated storage or deletion period has passed, files may be permanently deleted and recovery cannot be guaranteed.
Clients should therefore save completed photographs in more than one secure location.
16. Copyright
Copyright in all photographs remains with Sylvia Dobek Photography unless otherwise agreed in writing.
Purchasing digital photographs gives the client permission to use those images for personal purposes, including personal printing and sharing with friends and family.
Images may not be commercially reproduced, sold, entered into commercial licensing arrangements, materially altered for commercial use or presented as the work of another photographer without written permission.
Copyright ownership is separate from the client’s personal-use rights.
17. Social Media and Publication
Photographs may only be used by Sylvia Dobek Photography for portfolio, website, social media, advertising, competition or promotional purposes where the appropriate client permission or lawful basis applies.
Where a session package requires publication permission as part of its specific conditions, this will be stated before booking.
If a client has booked a session on the basis of private-image arrangements, those arrangements will be respected in accordance with the agreed session terms.
Questions about how personal information and photographs are handled should be read alongside the Privacy Policy and Cookie Policy.
18. Privacy and Personal Data
Sylvia Dobek Photography may collect information required to manage enquiries, bookings, payments, photography sessions, galleries, product orders and client communication.
Personal information is handled in accordance with the website’s Privacy Policy and applicable UK data protection requirements.
For independent guidance about how organisations should explain their use of personal information, you can also refer to the Information Commissioner’s Office (ICO).
The ICO advises businesses that privacy information should explain, among other things, why personal data is processed, how long it is kept and who it may be shared with.
19. Website Cookies
The website uses cookies and similar technologies for functionality, preferences, security, analytics and other purposes described in the Cookie Policy.
Where consent is required, visitors are provided with cookie choices through the website’s consent system.
More information is available in the Cookie Policy.
The ICO also publishes independent information about cookies and similar technologies.
20. Studio Property and Client Responsibility
Clients are expected to treat the photography studio, furniture, props, equipment and accessories with reasonable care.
Parents or guardians are responsible for supervising children when they are not being directly positioned or photographed.
Clients may be responsible for loss or damage caused deliberately or through unreasonable misuse of studio property, subject to applicable law.
21. Illness and Safety
Clients should contact Sylvia Dobek Photography before attending if the person being photographed, or someone accompanying them, has a contagious illness or other condition that could reasonably place newborn babies, children, clients or the photographer at risk.
Where appropriate, the session can be discussed and rearranged.
Sylvia Dobek Photography may stop or postpone a session where continuing would reasonably create a health or safety concern.
22. Circumstances Outside Our Control
Sylvia Dobek Photography will make reasonable efforts to provide the booked photography service.
However, circumstances such as serious illness, emergency, power failure, severe weather, equipment failure or other events outside reasonable control may occasionally require a session to be changed or rescheduled.
Where this happens, reasonable efforts will be made to arrange an appropriate alternative.
23. Liability
Sylvia Dobek Photography will provide photography services with reasonable care and skill.
Nothing in these Terms & Conditions is intended to exclude or limit liability where doing so would be unlawful.
Nothing in these Terms affects the client’s statutory consumer rights.
24. Changes to These Terms
These Terms & Conditions may be updated from time to time to reflect changes to photography services, business practices or legal requirements.
The version applying to a booking will normally be the version in force when the booking is confirmed, together with any additional terms specifically agreed for that session.
